President of Ukraine Viktor Yushchenko demands that all sides of the conflict around the State Property Fund be guided by the Constitution’s regulations. In his interview with journalists Yushchenko emphasized that according to the acting Constitution, the question on discharge and appointment of the State Property Fund Chairman is in the competence of the parliament.
“Nobody will change this norm of the law and I oblige all sides, which participate today in the conflict, to be guided only by the Constitution of Ukraine,” the President said.
He noted that illegitimately discharged or illegitimately appointed chairman of the State Property Fund is “the end of all privatization”. According to the President, this also discredits Ukraine, its power and seriously reduces cost of privatization objects.
He said that none of the force variant will take place. “I will strictly follow the Constitution concerning this question. I think that the government understands this, but for some reason it doesn’t make the correspondent conclusions,” Yushchenko said.
As earlier reported, on February 7 President of Ukraine Viktor Yushchenko by his degree stopped the Cabinet’s resolution of February 6 on Valentyna Semenyuk discharge from the position of the State Property Fund head. The President also sent the corresponding submission to the Constitutional Court concerning the constitutionality of the Cabinet’s resolution. According to the President, these resolutions of the government break the Constitution of Ukraine.
On April 15 Yushchenko issued a decree which suspended the resolution of the Tymoshenko government, dated February 11, on the terms of sale of the 99.52 % package of shares of the Odesa Pre-Port Plant.
On April 25 Prime Minister of Ukraine Yulia Tymoshenko represented new head of the State Property Fund of Ukraine, Andriy Portnov.
On April 25 the Prosecutor’s General Office of Ukraine protested against the Cabinet’s order to discharge Semenyuk from the position of the State Property Fund head in connection with the official investigation, and approved conditions of contest on sale of package shares of the Odesa Pre-Port Plant.
On April 25 the government declines the protests of the Prosecutor’s General Office.
